SUBSTITUTE TRUSTEE’S NOTICE OF SALE
WHEREAS, on the March 30, 2023, Kody W Kellogg and Catherine Kellogg, executed a Deed of Trust to Armistead Law, PLLC, Trustee for the use and benefit of Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for loanDepot.com, LLC, its successors and assigns, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Grenada County, Mississippi, in Deed of Trust March 31, 2023, in Book No. 2023, at Page 2641 thereof;
WHEREAS, said Deed of Trust was ultimately assigned to Select Portfolio Servicing, Inc. by assignment on file and of record in the office of the Chancery Clerk of Grenada County, Mississippi, in May 2, 2025, in Book No. 2025, at Page 3542 thereof; and
WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted Foundation Legal Group, LLP fka Wilson & Associates, PLLC, as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in October 14, 2025, in Book No. 2025, at Page 86 thereof; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that Foundation Legal Group, LLP fka Wilson & Associates, PLLC, Substitute Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will offer for sale and will sell at public sale and outcry to the highest and best bidder for certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee, during the legal hours (between the hours of 11 o’clock a.m. and 4 o’clock p.m.) Grenada County Courthouse, 59 Green Street, Grenada, MS 38901, on December 19, 2025, the following described land and property being the same land and property described in said Deed of Trust, situated in Grenada County, State of Mississippi, to-wit:
4.0 acres of land lying in the East 1/2 of the Northeast 1/4 of Section 15, Township 22 North, Range 5 East, Choctaw Meridian, Grenada County, Mississippi, and more particularly described as follows: Beginning at an iron bar located 1247.2 feet South and 720.8 feet West of the Northeast corner of said Section 15, thence S 49° E along the Southerly side of a road for 283.0 feet, thence S 35° E for 79.1 feet to an Iron bar, thence S 29° 15’ W for 150.0 feet to an iron bar, thence S 70° W along the Northerly side of a road for 446.0 feet to an iron bar, thence N 6°40’ W for 353.0 feet to an iron bar, thence N 56° 15’ E for 330.0 feet to the Point of Beginning. AND ALSO 6.22 acres of land, more or less, lying in the East 1/2 of the Northeast 1/4 of Section 15, Township 22 North. Range 5 East, Grenada County, Mississippi, and more particularly described as follows: Beginning at an iron bar located 385.5 feet North of the Southwest corner of the East 1/2 of the Northeast 1/4 of said Section 15; thence East for 346.6 feel to an iron bar at the Northwest corner of the Jack Cannon Property; thence North 8° 18’ East along a marked line for 335.9 feet to an iron bar on the Southerly side of a road; thence South 70° West for 93.0 feet to a point; thence North 20° West for 50.0 feet to a point; thence North 70° East for 93.0 feet to an iron bar; thence North 6° 40’ West for 353.00 feet to a point; thence North 57° 15’ East for 46.2 feet to a point; thence West for 375.9 feet to a point on the West line of the East 1/2 of the Northeast 1/4 of said Section 15; thence South along a marked line 755.3 feet to the point of beginning.
Title to the above described property is believed to be good, but I will convey only such title as is vested in the aforementioned Substitute Trustee.
