COMMISSIONER’S NOTICE
OF SALE
WHEREAS, on January 26, 2021,
Lauren H Abel executed a Deed of Trust (hereinafter the “Deed of Trust”) to Bancorp South Trustee for the benefit of Bancorp South, now Cadence Bank, as recorded in Deed of Trust Book 2021 at Page 564 in the land records of the Chancery Clerk of Grenada County, Mississippi; and
WHEREAS, by that certain Default Judgment and Final Judgment on the Pleadings Authorizing Judicial Foreclosure (“Judgment”) dated April 2, 2025, in the matter of Cadence Bank v. Lauren H Abel, et. al. Civil Action No. 25-CV-18PL, the Chancery Court appointed Underwood Law Firm, PLLC as the Court’s Commissioner to conduct a judicial foreclosure sale of the property encumbered by the Deed of Trust, as amended and corrected under the Judgment, in accordance with the terms of the Judgment and the Deed of Trust, in order to raise the sums due to Cadence Bank together with Commissioner’s fees, attorney’s fees, and expenses of sale; and
WHEREAS, Underwood Law Firm, LLC was duly appointed and authorized by Cadence Bank to act for and on its behalf as Commissioner of the foreclosure sale; and
WHEREAS, default having been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby having been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, Cadence Bank, having requested the undersigned Commissioner to execute the trust and sell the land and property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with Commissioner’s fees, attorney’s fees, and expenses of sale.
NOW, THEREFORE, we, Underwood Law Firm, PLLC, Commissioner, will on May 14, 2025, offer for sale at public outcry to the highest bidder for cash within legal hours (between the hours of 11 a.m. and 4 p.m. prevailing Central time) at the east door of the Grenada County Courthouse in Grenada, Mississippi, located at 59 Green Street, Grenada, Mississippi 38901, the following described land and property situated in Grenada County, Mississippi:
1.129 acres of land, more or less, lying in the northeast ¼ of Section 17, T-22-N, R-4-E, Grenada County, Mississippi and more particularly described as follows:
Beginning at a metal post on the east side of a public road located 1889.5 feet west and 532.7 feet north of the southeast corner of the northeast ¼ of said Section 17, thence easterly along the northerly side of the said public gravel road the following chords, S 11 degrees E for 100.0 feet, S 54 degrees E for 150.0 feet, S 88 degrees E for 75.0 feet, N 56 degrees E for 100.0 feet, N 45 degrees 35’ E for 75.1 feet to a metal post, thence in 38 degrees W for 105.3 feet to a metal post, thence run S 89 degrees 30’ W for 287.1 feet to the point of beginning.
PLEASE TAKE NOTICE that the foreclosure sale is subject to the conditions set forth in the Judgment that authorized this judicial foreclosure and that a hearing to consider confirmation of the sale is scheduled for May 28, 2025, at 9:00 a.m., prevailing Central time, before the Honorable Percy Lynchard, Jr. in the Grenada County Chancery Courthouse located in Grenada, Mississippi.
