NOTICE OF SALE
WHEREAS, on April 15, 2011, Elaine Long executed a Deed of Trust to Thelma A. Glasco, as Trustee for the benefit of the United States of America, acting through the Rural Housing Service or successor agency, United States Department of Agriculture, which Deed of Trust is on file and of record in the office of the Chancery Clerk of Grenada County, Mississippi, in Book 2011 at Page 2652 thereof; and
WHEREAS, the legal holder of the said Deed of Trust and the note secured thereby, substituted James E. Albertelli, P.A. dba ALAW as Trustee therein, as authorized by the terms thereof, by instrument recorded in the office of the aforesaid Chancery Clerk in Book 2024 at Page 63 thereof; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set forth by said Deed of Trust, and having been requested by the legal holder of the indebtedness secured and described by said Deed of Trust so to do, notice is hereby given that James E. Albertelli, P.A. dba ALAW, Substitute Trustee, by virtue of the authority conferred upon me in said Deed of Trust, will, on September 27, 2024, during the legal hours (between the hours of 11 o’clock a.m. and 4 o’clock p.m.), at the Grenada County Courthouse, East Door, 59 Green Street, Grenada, MS 38901, offer for sale and will sell at public sale and outcry to the highest and best bidder for certified funds, the following described land and property, being the same land and property described in said Deed of Trust, situated in Grenada County, State of Mississippi, to-wit:
LOT NUMBER 41 OF SUNDOWN ESTATES SUBDIVISION AS THE SAME APPEARS AND IS DESIGNATED ON THE MAP OR PLAT OF SAID SUBDIVISION ON FILE IN PLAT BOOK 3 AT PAGE 8 OF THE RECORDS OF PLATS ON FILE IN THE OFFICE OF THE CHANCERY CLERK OF GRENADA COUNTY, MISSISSIPPI.
SUBJECT TO THOSE RESTRICITIVE COVENANTS OF RECORD IN BOOK 171 AT PAGE 234 OF THE LAND DEED RECORDS FOR GRENADA COUNTY, MISSISSIPPI.
Commonly known as: 113 Kennedy Circle, Grenada, MS 38901
The entire purchase price is due and payable at the conclusion of the auction in the form of certified funds. Insufficient funds will not be accepted and no personal checks will be accepted. Amounts received in excess of the winning bid, will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
Should the undersigned become the last and highest bidder at the foreclosure sale, the Substitute Trustee is hereby authorized to transfer and assign said bid and to convey title to said foreclosed property to the Secretary of Veterans Affairs, an Officer of the United States of America, or the Secretary of Housing and Urban Development, an Officer of the United States of America, or whomever the undersigned shall authorize. The statement in the Substitute Trustee’s Deed that the undersigned has requested transfer of its bid to grantee(s) in the Substitute Trustee’s Deed shall be binding on the undersigned and conclusive evidence in favor of the assignee or other parties thereto and that the Substitute Trustee is duly authorized and empowered to execute same. Title to the above-described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.
