SUBSTITUTED TRUSTEE’S NOTICE OF SALE
WHEREAS, on November 15, 2024, Century Grenada, LLC, a Mississippi limited liability company (the “Borrower”) executed that certain Deed of Trust (the “Deed of Trust”) to Steven D. Settlemires, as trustee (the “Original Trustee”), for the use and benefit of The Citizens Bank of Philadelphia, a Mississippi banking corporation (the “Beneficiary”), which instrument was recorded in the Office of the Chancery Clerk of Grenada County, Mississippi (the “Recording Office”) on November 25, 2024, at Book 2024, Page 8986, said Deed of Trust being a renewal and extension of that certain Deed of Trust granted by Borrower in favor of Beneficiary on February 23, 2022, as recorded at Book 2022, Page 1833, and recorded in the Recording Office on February 25, 2022; and,
WHEREAS, effective as of June 30, 2025, pursuant to that certain Substitution of Trustee (the “Trustee Substitution”), Beneficiary substituted Alan Lee Smith (the “Substituted Trustee”) as trustee of the Deed of Trust, in the place and stead of the Original Trustee and of any other substituted trustee, which Trustee Substitution was recorded in the Recording Office on July 2, 2025, at Book 2025, Page 59, and thereafter spread upon the land records maintained by the Chancery Clerk of Grenada County, Mississippi; and
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby (the “Indebtedness”) having been declared to be due and payable in accordance with the terms of said Deed of Trust, Beneficiary has called upon the Substituted Trustee to execute the trust and make foreclosure thereof according to the terms of said Deed of Trust and applicable Mississippi law, for the purpose of raising the sums due thereunder, with the proceeds thereof to be applied in accordance with the terms and conditions of the Deed of Trust and related loan documents.
NOW, THEREFORE, I, Alan Lee Smith, acting solely in my capacity as Substituted Trustee, by virtue of the authority conferred upon me pursuant to the Deed of Trust and applicable Mississippi law, do hereby give notice that I will, between the legal hours of 11:00 a.m. and 4:00 p.m. on Thursday, August 21, 2025, offer for sale at public outcry at the East front door of the Grenada County Courthouse, located at 59 Green Street, Grenada, Mississippi, to the highest and best bidder for cash, the following described real property situated in Grenada County, Mississippi (the “Premises”), to-wit:
REAL PROPERTY
Part of the Southeast Quarter of the Northeast Quarter, and part of the Northeast Quarter of the Southeast Quarter, all in Section 13, Township 22 North, Range 4 East, City of Grenada, Grenada County, Mississippi; more particularly described as follows:
Beginning at a broken concrete Right of Way monument on the South Right of Way of Sunset Drive (Mississippi Highway 8), at its intersection with the Southerly line of Sweethome Road, said point being 899.90 feet North of and 328.00 feet West of the Southeast corner of the Northeast Quarter of said Section 13; from said point (broken Right of Way monument), run along said Right of Way South 35 degrees 39 minutes 00 seconds East for a distance of 327.00 feet to a set iron pin; thence run South 03 degrees 53 minutes 50 seconds East for a distance of 328.89 feet along the West Right of Way of Wooded Drive to a set iron pin; thence run South 83 degrees 33 minutes 02 seconds East for a distance of 25.14 feet to a set cotton picker spindle; thence run South 06 degrees 26 minutes 58 seconds West for a distance of 385.65 feet to a found iron pin; thence leaving Wooded Drive run North 66 degrees 10 minutes 02 seconds West for a distance of 565.11 feet to a found iron pin; thence run North 10 degrees 15 minutes 04 seconds West for a distance of 408.52 feet to a found iron pin; thence run North 30 degrees 17 minutes 00 seconds West for a distance of 123.55 feet to a set iron pin on the South Right of Way of Sweethome Road; thence run along said Right of Way the following 4 calls; thence run along a curve to the left a distance of 369.13 feet to a set iron pin, said curve having a radius of 1,273.24 feet, and a chord bearing North 62 degrees 08 minutes 52 seconds East for a distance of 369.14 feet; thence run South 35 degrees 54 minutes 52 seconds East for a distance of 15.00 feet to a found cotton picker spindle; thence run North 56 degrees 55 minutes 50 seconds East for a distance of 101.12 feet to a set iron pin; thence run North 54 degrees 02 minutes 29 seconds East for a distance of 47.63 feet back to the POINT OF BEGINNING, containing 9.87 acres more or less.
The above described description based on survey and plat of Williams, Clark, and Morrison, Inc. dated May 29, 2018.
Substituted Trustee will on the same date and at the same time and place, proceed to sell at public outcry to the highest and best bidder for cash, pursuant to the provisions of Sections 9-604 and 9-610 of the Uniform Commercial Code (Sections 75-9-604 and 75-9-610 of the Mississippi Code), all of Borrower’s right, title and interest in the following described personal property that may be located upon the Premises and/or may exist in association with Borrower’s use and enjoyment of the Premises, the Borrower having granted Beneficiary a security interest in said personal property pursuant to the Deed of Trust and/or other security instruments:
PERSONAL PROPERTY
All of Borrower’s right, title and interest in and to all of the following:
(1). All buildings, improvements and fixtures; all easements, rights of way, and appurtenances; all water, water rights and ditch rights (including stock in utilities with ditch or irrigation rights); and all other rights, royalties and profits relating to the Premises, including without limitation, all minerals, oil, gas, geothermal and similar matters;
(2). All equipment, fixtures, instruments, and other articles of personal property owned by Borrower and attached or affixed to the Premises, together with all accessions, parts, and additions to, all replacement of, and all substitutions for, any of such property; and together with all proceeds (including without limitation all insurance proceeds and refunds of premiums) from any sale or other disposition of the Premises; and,
(3). All rents, revenue, income, issues, royalties, profits, and other benefits derived from the Premises.
The foregoing real and personal property (collectively, the “Property”) shall be sold together on an “As Is, Where Is” basis without warranty or recourse, express or implied, as to title, possession, use and/or enjoyment, and subject to the following:
1. Any unpaid taxes against the Property;
2. Any recorded easements, conditions, covenants, rights-of-way or subdivision plats affecting the Property;
3. Any dedication of roads affecting the Property and any governmental zoning and subdivision ordinances or regulations in effect; and,
4. Any prior or superior liens, judgments, deeds of trust, or other interests of record and/or existing as a matter of law regarding the Property.
I shall convey only such title as is vested in me as Substituted Trustee.
